| NHỮNG QUY ĐỊNH CHUNG | GENERAL PROVISIONS |
| Điều 1. Phạm vi điều chỉnh | Article 1. Scope of regulation |
| Luật này quy định về hoạt động phòng, chống thiên tai, quyền và nghĩa vụ của cơ quan, tổ chức, hộ gia đình, cá nhân tham gia hoạt động phòng, chống thiên tai, quản lý nhà nước và nguồn lực bảo đảm việc thực hiện phòng, chống thiên tai. | This Law provides natural disaster prevention and control activities; rights and obligations of agencies, organizations, households and individuals engaged in natural disaster prevention and control activities; and the state management of, and assurance of resources for, natural disaster prevention and control. |
| Điều 2. Đối tượng áp dụng | Article 2. Subjects of application |
| Luật này áp dụng đối với cơ quan, tổ chức, hộ gia đình, cá nhân Việt Nam; tổ chức, cá nhân nước ngoài, tổ chức quốc tế đang sinh sống, hoạt động hoặc tham gia phòng, chống thiên tai tại Việt Nam. | This Law applies to Vietnamese agencies, organizations, households and individuals; foreign organizations and individuals and international organizations that are residing or operating or engaged in natural disaster prevention and control in Vietnam. |
| Điều 3. Giải thích từ ngữ | Article 3. Interpretation of terms |
| Trong Luật này, các từ ngữ dưới đây được hiểu như sau: | In this Law, the terms below are construed as follows: |
| 1. Thiên tai là hiện tượng tự nhiên bất thường có thể gây thiệt hại về người, tài sản, môi trường, điều kiện sống và các hoạt động kinh tế - xã hội, bao gồm: bão, áp thấp nhiệt đới, lốc, sét, mưa lớn, lũ, lũ quét, ngập lụt, sạt lở đất do mưa lũ hoặc dòng chảy, sụt lún đất do mưa lũ hoặc dòng chảy, nước dâng, xâm nhập mặn, nắng nóng, hạn hán, rét hại, mưa đá, sương muối, động đất, sóng thần và các loại thiên tai khác. | 1. Natural disasters means abnormal natural phenomena which may cause damage to human life, property, the environment, living conditions and socio- economic activities. Natural disasters include typhoon, tropical low pressure, whirlwind, lightning, heavy rain, flood, flashflood, inundation, landslide and land subsidence due to floods or water currents, water rise, seawater intrusion, extreme hot weather, drought, damaging cold, hail, hoarfrost, earthquake, tsunami and other types of natural disaster. |
| 2. Rủi ro thiên tai là thiệt hại mà thiên tai có thể gây ra về người, tài sản, môi trường, điều kiện sống và hoạt động kinh tế - xã hội. | 2. Natural disaster risk means damage, which natural disasters may cause to human life, property, the environment, living conditions and socio-economic activities. |
| 3. Phòng, chống thiên tai là quá trình mang tính hệ thống, bao gồm hoạt động phòng ngừa, ứng phó và khắc phục hậu quả thiên tai. | 3. Natural disaster prevention and control means a systematic process involving the prevention of, response to, and remediation of consequences of, natural disasters. |
| 4. Đối tượng dễ bị tổn thương là nhóm người có đặc điểm và hoàn cảnh khiến họ có khả năng phải chịu nhiều tác động bất lợi hơn từ thiên tai so với những nhóm người khác trong cộng đồng. Đối tượng dễ bị tổn thương bao gồm trẻ em, người cao tuổi, phụ nữ đang mang thai hoặc đang nuôi con dưới 12 tháng tuổi, người khuyết tật, người bị bệnh hiểm nghèo và người nghèo. | 4. Vulnerable group means a group of people who, due to their characteristics and circumstances, are likely to suffer more adverse impacts of natural disasters than other groups in the community. Vulnerable groups include children, elderly people, pregnant women, women nursing under-12-month children, people with disabilities, people suffering from dangerous diseases and poor people. |
| 5. Công trình phòng, chống thiên tai là công trình do Nhà nước, tổ chức, cá nhân đầu tư, xây dựng, bao gồm trạm quan trắc khí tượng, thủy văn, hải văn, địa chấn, cảnh báo thiên tai; công trình đê điều, hồ đập, chống úng, chống hạn, chống sạt lở; khu neo đậu tránh trú bão cho tàu thuyền, nhà kết hợp sơ tán dân và công trình khác phục vụ phòng, chống thiên tai. | 5. Natural disaster prevention and control works means works, which are built with investment funds of the State, organizations or individuals, including meteorological, hydrographical, oceanographic and seismic observatories, disaster warning stations; dikes, reservoirs and dams, anti- inundation, anti-drought and anti-landslide facilities; storm shelters for ships and boats, evacuation houses and other facilities serving natural disaster prevention and control. |
| Điều 4. Nguyên tắc cơ bản trong phòng, chống thiên tai | Article 4. Basic principles of natural disaster prevention and control |
| 1. Phòng ngừa chủ động, ứng phó kịp thời, khắc phục khẩn trương và hiệu quả. | 1. Proactive prevention, timely response to, and urgent and effective remediation of consequences of natural disasters. |
| 2. Phòng, chống thiên tai là trách nhiệm của Nhà nước, tổ chức, cá nhân, trong đó Nhà nước giữ vai trò chủ đạo, tổ chức và cá nhân chủ động, cộng đồng giúp nhau. | 2. Natural disaster prevention and control are the responsibility of the State, organizations and individuals in which the State plays the key role, organizations and individuals play a proactive role and communities help one another. |
| 3. Phòng, chống thiên tai được thực hiện theo phương châm bốn tại chỗ: chỉ huy tại chỗ; lực lượng tại chỗ; phương tiện, vật tư tại chỗ; hậu cần tại chỗ. | 3. Natural disaster prevention and control are carried out under the ‘four on- the-spot motto’: command on the spot, manpower on the spot, means and supplies on the spot and logistics on the spot. |
| 4. Lồng ghép nội dung phòng, chống thiên tai trong quy hoạch, kế hoạch phát triển kinh tế - xã hội của cả nước, địa phương và quy hoạch, kế hoạch phát triển ngành. | 4. Natural disaster prevention and control contents must be integrated into national and local socio-economic development master plans and plans and sectoral development master plans and plans. |
| 5. Phòng, chống thiên tai phải bảo đảm tính nhân đạo, công bằng, minh bạch và bình đẳng giới. | 5. Humanity, fairness, transparency and gender equity must be guaranteed in natural disaster prevention and control. |
| 6. Phòng, chống thiên tai phải dựa trên cơ sở khoa học; kết hợp sử dụng kinh nghiệm truyền thống với tiến bộ khoa học và công nghệ; kết hợp giải pháp công trình và phi công trình; bảo vệ môi trường, hệ sinh thái và thích ứng với biến đổi khí hậu. | 6. Natural disaster prevention and control activities must be based on scientific grounds, combining traditional experiences and scientific and technological advances, combining structural and non-structural solutions; protecting the environment and eco-systems and adapting to climate change. |
| 7. Phòng, chống thiên tai được thực hiện theo sự phân công, phân cấp, phối hợp chặt chẽ giữa các lực lượng và phù hợp với các cấp độ rủi ro thiên tai. | 7. Natural disaster prevention and control activities are assigned, decentralized and closely coordinated among involved forces and conform to the levels of natural disaster risks. |
| Điều 5. Chính sách của Nhà nước trong phòng, chống thiên tai | Article 5. State policies on disaster prevention and control |
| 1. Có chính sách đồng bộ về đầu tư, huy động nguồn lực và giải pháp tổ chức thực hiện công tác phòng, chống thiên tai; đầu tư xây dựng công trình phòng, chống thiên tai trọng điểm và hỗ trợ địa phương xây dựng công trình phòng, chống thiên tai theo phân cấp của Chính phủ. | 1. To adopt synchronous policies on investment and resource mobilization and solutions for organizing natural disaster prevention and control; to build key natural disaster prevention and control works and support localities in building natural disaster prevention and control works as decentralized by the Government. |
| 2. Đào tạo, giáo dục, huấn luyện, tuyên truyền nâng cao nhận thức cộng đồng và người dân trong việc tuân thủ pháp luật và tham gia vào công tác phòng, chống thiên tai. | 2. To provide training and education and conduct public information campaigns to raise people’s and communities’ sense of law observance and involvement in natural disaster prevention and control. |
| 3. Đầu tư cơ sở hạ tầng vùng thường xuyên bị thiên tai; di dời dân sinh sống ở khu vực nguy hiểm đến nơi an toàn; hỗ trợ về đời sống và sản xuất đối với đối tượng bị thiệt hại do thiên tai gây ra, ưu tiên vùng thường xuyên chịu tác động của thiên tai, đối tượng dễ bị tổn thương. | 3. To invest in infrastructure in areas where natural disasters frequently occur; to relocate people living in dangerous areas to safe areas; to support the livelihoods and production of those suffering from damage caused by natural disasters, giving priority to areas frequently affected by natural disasters and vulnerable groups. |
| 4. Khuyến khích tổ chức, hộ gia đình, cá nhân chủ động thực hiện biện pháp phòng, chống thiên tai; khuyến khích tổ chức, cá nhân đầu tư xây dựng công trình, nghiên cứu và áp dụng tiến bộ khoa học, công nghệ vào hoạt động phòng, chống thiên tai. Nhà nước bảo vệ quyền và lợi ích hợp pháp của tổ chức, cá nhân tham gia phòng, chống thiên tai. | 4. To encourage organizations, households and individuals to take proactively disaster prevention and control measures; to encourage organizations and individuals to build natural disaster prevention and control works, and research and apply scientific and technological advances in natural disaster prevention and control activities. The State protects the rights and lawful interests of organizations and individuals engaged in natural disaster prevention and control. |
| 5. Ưu đãi, khuyến khích doanh nghiệp bảo hiểm kinh doanh bảo hiểm rủi ro thiên tai; hỗ trợ đối với doanh nghiệp tham gia đầu tư sản xuất, kinh doanh ở vùng thường xuyên chịu tác động của thiên tai theo quy định của pháp luật về đầu tư, pháp luật về doanh nghiệp và pháp luật về phòng, chống thiên tai; chính sách miễn, giảm thuế thu nhập doanh nghiệp đối với các khoản đóng góp cho phòng, chống thiên tai. | 5. To offer incentives to and encourage insurance businesses to provide insurance against natural disaster risks; to support businesses conducting production and business activities in areas frequently affected by natural disasters in accordance with the laws on investment, enterprises and natural disaster prevention and control; to offer enterprise income tax exemption and reduction with regard to contributions made for natural disaster prevention and control purposes. |
| Điều 6. Nguồn nhân lực cho phòng, chống thiên tai | Article 6. Manpower for natural disaster prevention and control |
| 1. Tổ chức, hộ gia đình và cá nhân trên địa bàn là lực lượng tại chỗ thực hiện hoạt động phòng, chống thiên tai. | 1. Local organizations, households and individuals are on-the-spot forces, which shall carry out natural disaster prevention and control activities. |
| 2. Dân quân tự vệ là lực lượng tại chỗ thực hiện nhiệm vụ phòng, chống thiên tai theo phương án phòng, chống thiên tai của địa phương và sự điều động của người có thẩm quyền. | 2. Militia and self-defense forces are on-the-spot forces, which shall perform natural disaster prevention and control tasks under local natural disaster prevention and control plans and the mobilization of competent persons. |
| 3. Quân đội nhân dân, Công an nhân dân có trách nhiệm thực hiện nhiệm vụ phòng, chống thiên tai và là lực lượng nòng cốt trong công tác sơ tán người, phương tiện, tài sản, cứu hộ, cứu nạn, bảo đảm an ninh, trật tự an toàn xã hội theo sự điều động của người có thẩm quyền. | 3. The People’s Army and People’s Public Security forces shall perform natural disaster prevention and control tasks and act as the core in the evacuation of people, means and properties, rescue and salvage and assurance of security and social order and safety under the mobilization of competent persons. |
| 4. Tổ chức, cá nhân tình nguyện tham gia hỗ trợ hoạt động phòng, chống thiên tai theo sự chỉ huy của người có thẩm quyền. | 4. Organizations and individuals that voluntarily support natural disaster prevention and control activities shall follow the command of competent persons. |
| Điều 7. Vật tư, phương tiện, trang thiết bị, hệ thống thông tin, nhu yếu phẩm cho hoạt động phòng, chống thiên tai | Article 7. Supplies, means, equipment, information systems and essentials for natural disaster prevention and control activities |
| 1. Vật tư, phương tiện, trang thiết bị cho hoạt động phòng, chống thiên tai bao gồm vật tư, phương tiện, trang thiết bị của Nhà nước; huy động của tổ chức, cá nhân trên địa bàn; của tổ chức, cá nhân, hộ gia đình tự chuẩn bị. | 1. Supplies, means and equipment for natural disaster prevention and control activities include supplies, means and equipment of the State; supplies, means and equipment mobilized from local organizations and individuals; and supplies, means and equipment prepared by organizations, individuals and households themselves. |
| 2. Hệ thống thông tin phục vụ quản lý nhà nước và hoạt động phòng, chống thiên tai bao gồm: | 2. Information systems serving the state management and natural disaster prevention and control activities include: |
| a) Cơ sở hạ tầng thông tin gồm hệ thống thông tin công cộng và trang thiết bị chuyên dùng phục vụ cho hoạt động chỉ đạo, chỉ huy phòng, chống thiên tai; thiết bị quan trắc tự động truyền tin; hệ thống thông tin cảnh báo sớm; | a/ Information infrastructure, including public information systems and specialized equipment serving the direction and command of natural disaster prevention and control activities; automated data-transmission observation equipment; and early warning systems; |
| b) Cơ sở dữ liệu về thông tin gồm cơ sở dữ liệu về khí tượng, thủy văn, hải văn, động đất, sóng thần; cơ sở dữ liệu về thiên tai và thiệt hại thiên tai; cơ sở dữ liệu về hệ thống công trình phòng, chống thiên tai; cơ sở dữ liệu về công trình hạ tầng có liên quan đến phòng, chống thiên tai; số liệu quan trắc và truyền phát tự động tại thời điểm thiên tai đang diễn ra. | b/ Databases, including meteorological, hydrographical, oceanographic, seismic, earthquake and tsunami information database; database on natural disasters and damage caused by natural disasters; database on the system of natural disaster prevention and control works; database on infrastructure facilities related to natural disaster prevention and control; and data automatically observed and transmitted during natural disasters. |

Nhu yếu phẩm của tổ chức, cá nhân và hàng hóa, vật tư, thiết bị thuộc dự trữ quốc gia của cơ quan nhà nước phục vụ cho hoạt động phòng, chống thiên tai bao gồm lương thực, thuốc chữa bệnh, nước uống, hóa chất, thiết bị xử lý nước, thuốc khử trùng và vật phẩm cần thiết khác để bảo đảm đời sống nhân dân khi thiên tai xảy ra. | 3. Essentials of organizations and individuals and national reserves, goods, supplies and equipment of state agencies serving natural disaster prevention and control activities including: food, curative medicines, drinking water, water treatment chemicals and equipment, disinfectants and other necessary articles to assure people’s lives when natural disasters occur. |

| 1. Ngân sách nhà nước cho phòng, chống thiên tai bao gồm ngân sách nhà nước theo dự toán chi hằng năm và dự phòng ngân sách nhà nước. | 1. State budget funds for natural disaster prevention and control include funds within annual expenditure estimates and state budget provisions. |
| 2. Ngân sách nhà nước cho phòng, chống thiên tai theo dự toán chi hằng năm được sử dụng cho xây dựng chiến lược, kế hoạch phòng, chống thiên tai; đầu tư, xây dựng, tu bổ, nâng cấp công trình phòng, chống thiên tai; hoạt động phòng, chống thiên tai; hoạt động thường xuyên của cơ quan quản lý nhà nước về phòng, chống thiên tai các cấp. | 2. | 3. Dự phòng ngân sách nhà nước cho phòng, chống thiên tai được sử dụng theo quy định sau đây: | 3. State budget provisions for natural disaster prevention and control are used according to the following provisions: |
| a) Hỗ trợ cho công tác ứng phó và khắc phục hậu quả thiên tai; | a/ To support the response to, and remediation of the consequences of, natural disasters; |
| b) Căn cứ vào hoạt động ứng phó, mức độ thiệt hại, nhu cầu cứu trợ và các chế độ, chính sách, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là cấp tỉnh), Ủy ban nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh (sau đây gọi chung là cấp huyện), Ủy ban nhân dân xã, phường, thị trấn (sau đây gọi chung là cấp xã) quyết định cấp dự phòng ngân sách của địa phương để xử lý các nhu cầu khẩn cấp cho ứng phó và khắc phục hậu quả thiên tai ngoài dự toán chi hằng năm đã được phê duyệt; | b/ Based on response activities, the extent of damage, relief needs, prescribed regimes and policies, the People’s Committees of provinces and municipalities running cities (referred to below as the provincial level), the People’s Committees of districts, towns and provincial cities (referred to below as the district level) and the People’s Committees of communes, wards and townships (referred to below as commune level) shall decide to allocate local budget provisions to meet urgent needs to respond to, and remedy the consequences of natural disasters, which are not covered by the approved annual expenditure estimates; |
| c) Trường hợp dự phòng ngân sách địa phương đã chi hết nhưng không đủ đáp ứng cho các nhu cầu khẩn cấp, Chủ tịch Ủy ban nhân dân cấp tỉnh đề nghị Thủ tướng Chính phủ hỗ trợ. Ban chỉ đạo trung ương về phòng, chống thiên tai tổng hợp tình hình thiệt hại, nhu cầu hỗ trợ của địa phương và đề xuất Thủ tướng Chính phủ quyết định. | c/ In case the local budget provisions are used up and insufficient to meet urgent needs, provincial-level People’s Committee chairpersons may propose to the Prime Minister to provide support. The Central Steering Committee for Natural Disaster Prevention and Control shall summarize the damage and support needs of localities and propose the support required to the Prime Minister for his decision. |
| Điều 10. Quỹ phòng, chống thiên tai | Article 10. Natural disaster prevention and control funds |
| 1. Quỹ phòng, chống thiên tai là quỹ được thành lập ở cấp tỉnh, do Ủy ban nhân dân cấp tỉnh quản lý. Quỹ phòng, chống thiên tai không bao gồm ngân sách nhà nước và không có nguồn gốc từ ngân sách nhà nước. | 1. Natural disaster prevention and control funds are set up at the provincial level and managed by provincial-level People’s Committees. Natural disaster prevention and control funds neither include state budget funds nor originate from the state budget. |
| 2. Nguồn tài chính của Quỹ phòng, chống thiên tai: | 2. Financial sources of natural disaster prevention and control funds: |
| a) Đóng góp bắt buộc của tổ chức kinh tế trong nước và nước ngoài tại địa bàn, công dân Việt Nam từ đủ 18 tuổi đến hết tuổi lao động theo quy định của pháp luật; | a/ Compulsory contributions of domestic and foreign economic organizations based in localities, and Vietnamese citizens aged from full 18 years and in the working age as prescribed by law; |
| b) Các nguồn hợp pháp khác. | b/ Other lawful sources. |
| 3. Quỹ phòng, chống thiên tai được sử dụng để hỗ trợ hoạt động phòng, chống thiên tai và ưu tiên hỗ trợ cho các hoạt động sau đây: | 3. Natural disaster prevention and control funds are used to support natural disaster prevention and control activities, with priority given to the following activities: |
| a) Cứu trợ khẩn cấp về lương thực, nước uống, thuốc chữa bệnh và các nhu cầu cấp thiết khác cho đối tượng bị thiệt hại do thiên tai; | a/ Providing emergency relief in food, drinking water, curative medicines and other essentials to those suffering from damage caused by natural disasters. |
| b) Hỗ trợ tu sửa nhà ở, cơ sở y tế, trường học; | b/ Supporting the repair of houses, health establishments and schools; |
| c) Xử lý vệ sinh môi trường vùng thiên tai. | c/ Handling environmental sanitation issues in natural disaster-hit areas. |
| 4. Việc quản lý, sử dụng Quỹ phòng, chống thiên tai phải bảo đảm đúng mục đích, kịp thời, công khai, minh bạch, công bằng và hiệu quả. | 4. Natural disaster prevention and control funds must be managed and used in a proper, timely, public, transparent, equal and effective manner. |
| 5. Chính phủ quy định cụ thể việc thành lập, mức đóng góp, đối tượng được miễn, giảm, tạm hoãn đóng góp, quản lý, sử dụng và thanh quyết toán Quỹ phòng, chống thiên tai. | 5. The Government shall specify the setting up of natural disaster prevention and control funds, the levels of contributions, subjects eligible for exemption from, reduction or suspension of payment of, contributions, and the management, use, payment and finalization of those funds. |
| Điều 11. Nguồn đóng góp tự nguyện cho phòng, chống thiên tai | Article 11. Voluntary contributions for natural disaster prevention and control |
| 1. Đóng góp tự nguyện của tổ chức, cá nhân cho công tác phòng, chống thiên tai dưới các hình thức: đóng góp vào quỹ xã hội, quỹ từ thiện; tham gia quyên góp theo quy định của pháp luật và hỗ trợ trực tiếp cho tổ chức, hộ gia đình, cá nhân bị thiệt hại do thiên tai. | 1. Organizations and individuals may make voluntary contributions for natural disaster prevention and control in the form of contributions to social funds or charity funds; participating in lawful fundraising events, and providing direct support to organizations, households and individuals suffering from damage caused by natural disasters. |
| 2. Việc phân bổ, sử dụng nguồn đóng góp tự nguyện quy định tại khoản 1 Điều này được thực hiện theo quy định của pháp luật về quỹ xã hội, quỹ từ thiện và có sự thống nhất của chính quyền địa phương nơi có đối tượng được hỗ trợ. | 2. Voluntary contributions prescribed in Clause 1 of this Article must be allocated and used in accordance with the law on social funds and charity funds and with the agreement of the administrations of localities where supported people reside. |
| Điều 12. Các hành vi bị cấm | Article 12. Prohibited acts |
| 1. | c) Xác định nội dung, biện pháp tổng thể, chương trình đề án, dự án phòng chống thiên tai phù hợp với các cấp độ rủi ro thiên tai và loại thiên tai nhằm giảm thiểu rủi ro thiên tai, chú ý khu vực nguy hiểm và đối tượng dễ bị tổn thương; | c/ Identifying overall natural disaster prevention and control contents, measures, programs, schemes and projects suitable to each level of natural disaster risk and specific type of natural disaster so as to minimize natural disaster risks, paying attention to dangerous areas and vulnerable groups; |
| d) Xác định nội dung phòng, chống thiên tai cần lồng ghép vào quy hoạch, kế hoạch phát triển kinh tế - xã hội của cả nước; | d/ Identifying natural disaster prevention and control contents to be integrated into national socio-economic development master plans and plans; |
| đ) Xác định nguồn lực và tiến độ hằng năm và 05 năm để thực hiện kế hoạch phòng, chống thiên tai; | dd/ Identifying resources and schedules for implementation of the plan each year and during the five-year period; |

| 7. Trách nhiệm xây dựng kế hoạch phòng, chống thiên tai được quy định như sau: | 7. The responsibilities to elaborate natural disaster prevention and control plans are provided as follows: |
| a) Ủy ban nhân dân các cấp tổ chức xây dựng, phê duyệt kế hoạch phòng, chống thiên tai của địa phương, báo cáo Ủy ban nhân dân cấp trên tổng hợp, chỉ đạo. Ủy ban nhân dân cấp tỉnh báo cáo kế hoạch phòng, chống thiên tai với Bộ Nông nghiệp và Phát triển nông thôn và Bộ Quốc phòng; | a/ People’s Committees at all levels shall elaborate and approve local natural disaster prevention and control plans and report such plans to the higher-level People’s Committees for summarization and direction. Provincial-level People’s Committees shall report provincial-level natural disaster prevention and control plans to the Ministry of Agriculture and Rural Development and the Ministry of National Defense; |

| Điều 19. Bảo đảm yêu cầu phòng, chống thiên tai đối với việc đầu tư xây dựng mới hoặc nâng cấp khu đô thị, điểm dân cư nông thôn và công trình hạ tầng kỹ thuật | Article 19. Assurance of natural disaster prevention and control requirements in the construction or upgrading of urban centers, rural residential spots and technical infrastructure works |
| 1. Chủ đầu tư khi lập và thực hiện dự án đầu tư xây dựng mới hoặc nâng cấp khu đô thị, điểm dân cư nông thôn và công trình hạ tầng kỹ thuật phải bảo đảm các yêu cầu về phòng, chống thiên tai, bao gồm: | 1. When formulating and implementing investment projects to build or upgrade urban centers, rural residential spots and technical infrastructure works, investors must meet natural disaster prevention and control requirements, specifically: |
| a) Hạn chế đến mức thấp nhất hoặc không làm tăng nguy cơ rủi ro thiên tai và bảo đảm tính ổn định của công trình trước thiên tai; | a/ Minimizing or not increasing natural disaster risks and assuring the stability of the works during natural disasters; |

Người có thẩm quyền phê duyệt dự án đầu tư có trách nhiệm tổ chức thẩm định nội dung về bảo đảm yêu cầu phòng, chống thiên tai trong hồ sơ dự án xây dựng mới hoặc nâng cấp khu đô thị, điểm dân cư nông thôn và công trình hạ tầng kỹ thuật trước khi phê duyệt dự án. | 2. | Điều 20. Xây dựng và bảo vệ công trình phòng, chống thiên tai và công trình kết hợp phòng, chống thiên tai | Article 20. Construction and protection of natural disaster prevention and control works and works concurrently serving natural disaster prevention and control purposes |
| 1. Việc xây dựng công trình phòng, chống thiên tai phải tuân thủ quy hoạch, kế hoạch được cấp có thẩm quyền phê duyệt, tiêu chuẩn, quy chuẩn kỹ thuật quốc gia; áp dụng công nghệ tiên tiến, hiện đại, đặc biệt đối với việc xây dựng, nâng cấp và mở rộng mạng lưới đài, trạm quan trắc khí tượng, thủy văn, hải văn, địa chấn, trạm thu nhận thông tin cảnh báo sớm về mưa, bão, lũ, động đất, sóng thần. | 1. | a) Chính phủ phân công và phân cấp việc đầu tư xây dựng công trình phòng, chống thiên tai bảo đảm tính hiệu quả và thống nhất; Thủ tướng Chính phủ phê duyệt quy hoạch, kế hoạch, chương trình, đề án quốc gia xây dựng hệ thống công trình phòng, chống thiên tai; bố trí đủ nguồn lực để thực hiện chương trình, đề án, dự án; | a/ The Government shall assign and decentralize the construction of natural disaster prevention and control works to ensure efficiency and uniformity. The Prime Minister shall approve national master plans, plans, programs and schemes on the construction of natural disaster prevention and control works, and allocate sufficient resources for implementation of these plans, programs and schemes; |
| b) Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân cấp tỉnh có trách nhiệm phê duyệt và tổ chức thực hiện quy hoạch, kế hoạch đầu tư xây dựng công trình phòng, chống thiên tai theo phân công, phân cấp của Chính phủ; quản lý việc đầu tư xây dựng công trình phòng, chống thiên tai thuộc thẩm quyền; | b/ Ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees shall approve, and organize the implementation of, master plans and plans on the construction of natural disaster prevention and control works as assigned and decentralized by the Government, and manage such construction according to their competence; |

| Điều 21. Thông tin, truyền thông và giáo dục về phòng, chống thiên tai | Article 21. Information, communication and education about natural disaster prevention and control |
| 1. Việc thông tin, truyền thông và giáo dục về phòng, chống thiên tai nhằm cung cấp kiến thức về các loại thiên tai, tác động của thiên tai, biện pháp phòng, chống thiên tai, trách nhiệm của tổ chức, cá nhân trong hoạt động phòng, chống thiên tai và quy định của pháp luật có liên quan. | 1. Information, communication and education about natural disaster prevention and control aim to provide knowledge about types of natural disasters, impacts of natural disasters, measures to prevent and control natural disasters, responsibilities of organizations and individuals in natural disaster prevention and control activities, and relevant laws. |

| b) Xây dựng tài liệu chuyên đề, tạp chí, tờ rơi, trong đó có tài liệu bằng tiếng dân tộc; | b/ Developing specialized documents, journals and leaflets, including documents in ethnic minority languages; |
| c) Tổ chức triển lãm, hội thảo, tập huấn, diễn tập phòng, chống thiên tai; | c/ Holding exhibitions, workshops and training courses on and drills on natural disaster prevention and control; |
| d) Lồng ghép kiến thức phòng, chống thiên tai vào chương trình các cấp học; | d/ Integrating natural disaster prevention and control knowledge into curricula of all educational levels; |
| đ) Tổ chức diễn đàn về phòng, chống thiên tai để tham vấn rộng rãi về chính sách, pháp luật, chia sẻ thông tin và kinh nghiệm về phòng, chống thiên tai. | dd/ Holding natural disaster prevention and control forums for extensive consultation on policies and laws and share information and experiences on natural disaster prevention and control. |
| 3. Trách nhiệm thông tin, truyền thông và giáo dục về phòng, chống thiên tai được quy định như sau: | 3. The responsibility to conduct information, communication and education about natural disaster prevention and control is provided as follows: |
| a) Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các cấp trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm xây dựng, quản lý, vận hành hệ thống phát thanh, truyền hình, truyền thông và hệ thống truyền tin khác để thu thập, truyền, phát tin dự báo, cảnh báo thiên tai đáp ứng nhu cầu tiếp cận thông tin dự báo, cảnh báo thiên tai của tổ chức, cá nhân và cộng đồng; tổ chức thông tin, truyền thông và giáo dục về phòng, chống thiên tai; | a/ Ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees shall, within the scope of their tasks and powers, build, manage and operate radio and television broadcasting systems, communication systems and other information transmission systems for collecting and transmitting information on natural disaster forecasts and warnings for organizations, individuals and communities; and organize information, communication and education about natural disaster prevention and control; |
| b) Bộ Thông tin và Truyền thông chỉ đạo, hướng dẫn các cơ quan thông tin đại chúng thực hiện việc thông tin, truyền thông về phòng, chống thiên tai; | b/ The Ministry of Information and Communications shall direct and guide mass media agencies in conducting information and communication about natural disaster prevention and control; |
| c) Bộ Giáo dục và Đào tạo chỉ đạo, hướng dẫn việc lồng ghép kiến thức phòng, chống thiên tai vào chương trình các cấp học; | c/ The Ministry of Education and Training shall direct and guide the integration of natural disaster prevention and control knowledge into curricula of all educational levels; |
| d) Bộ Nông nghiệp và Phát triển nông thôn chỉ đạo, tổ chức thực hiện chương trình, đề án về nâng cao nhận thức cộng đồng và quản lý thiên tai dựa vào cộng đồng; | d/ The Ministry of Agriculture and Rural Development shall direct and organize the implementation of programs and schemes on raising public awareness and community-based natural disaster management; |
| đ) Tổ chức, hộ gia đình, cá nhân có trách nhiệm tham gia vào hoạt động thông tin, truyền thông và giáo dục về phòng, chống thiên tai; trang bị thiết bị tiếp nhận thông tin dự báo, cảnh báo thiên tai. | dd/ Organizations, households and individuals shall participate in information, communication and education about natural disaster prevention and control; and furnish themselves with equipment for receiving natural disaster forecasts and warnings. |
| Điều 22. Phương án ứng phó thiên tai | Article 22. Natural disaster response plans |
| 1. Phương án ứng phó thiên được xây dựng dựa trên các căn cứ sau đây: | 1. A natural disaster response plan is formulated based on the following grounds: |
| a) Các loại thiên tai và cấp độ rủi ro thiên tai có khả năng xảy ra tại địa phương và lĩnh vực quản lý; | a/ Types of natural disasters and levels of natural disaster risks, which are likely to occur in localities and fields under management; |
| b) Năng lực ứng phó thiên tai của tổ chức, cá nhân; | b/ Natural disaster response capacity of organizations and individuals; |
| c) Khả năng phối hợp và hỗ trợ của các lực lượng và chính quyền các cấp. | c/ Ability for coordination among and support of, different forces and local administrations at all levels. |
| 2. Phương án ứng phó thiên tai bao gồm các nội dung chính sau đây: | 2. A natural disaster response plan contains the following principal contents: |
| a) Bảo vệ công trình phòng, chống thiên tai và công trình trọng điểm; | a/ Protection of natural disaster prevention and control works and key works; |

| c) Bảo đảm an ninh trật tự, giao thông, thông tin liên lạc; | c/ Assurance of security, order, transport and communication; |
| d) Phối hợp chỉ đạo, chỉ huy phòng tránh, ứng phó thiên tai và tìm kiếm cứu nạn; | d/ Coordination in directing and commanding the prevention of and response to natural disasters and search and rescue; |
| đ) Nguồn nhân lực ứng phó thiên tai; | dd/ Manpower to respond to natural disasters; |
| e) Dự trữ vật tư, phương tiện, trang thiết bị, nhu yếu phẩm. | e/ Reserves of supplies, means, equipment and essentials. |
| 3. Phương án ứng phó thiên tai được xây dựng ở địa phương, bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và cơ quan, tổ chức khác; phương án ứng phó thiên tai được rà soát, điều chỉnh, bổ sung hằng năm. | 3. Natural disaster response plans are formulated for localities, ministries, ministerial-level agencies, government-attached agencies as well as other agencies and organizations; and annually reviewed, adjusted and supplemented. |
| 4. Trách nhiệm hướng dẫn, xây dựng, phê duyệt phương án ứng phó thiên tai được quy định như sau: | 4. The responsibility to guide, formulate and approve natural disaster response plans is provided as follows: |
| a) Ban chỉ đạo trung ương về phòng, chống thiên tai có trách nhiệm chủ trì, phối hợp với Ủy ban quốc gia tìm kiếm cứu nạn hướng dẫn xây dựng phương án ứng phó tương ứng với các cấp độ rủi ro thiên tai; | a/ The Central Steering Committee for Natural Disaster Prevention and Control shall assume the prime responsibility for, and coordinate with the National Committee for Search and Rescue in, guiding the formulation of response plans corresponding to levels of natural disaster risks; |
| b) Thủ trưởng cơ quan, tổ chức có trách nhiệm tổ chức xây dựng và phê duyệt phương án ứng phó thiên tai của cơ quan, đơn vị mình, gửi đến Ủy ban nhân dân địa phương có liên quan trên địa bàn và cơ quan cấp trên để phối hợp chỉ đạo thực hiện; | b/ Heads of agencies or organizations shall organize the formulation of, and approve their own natural disaster response plans and send them to related local People’s Committees and their superior agencies for coordinated direction of implementation; |

Manpower, supplies, means, equipment and essentials for natural disaster prevention and control activities must be prepared under approved natural disaster response plans. |
| 2. Tổ chức, hộ gia đình, cá nhân có trách nhiệm chủ động chuẩn bị nhân lực, vật tư, phương tiện, trang thiết bị, nhu yếu phẩm phục vụ hoạt động phòng, chống thiên tai theo hướng dẫn của Ban chỉ đạo trung ương về phòng, chống thiên tai và Ủy ban quốc gia tìm kiếm cứu nạn. | 2. Organizations, households and individuals shall take the initiative in preparing manpower, supplies, means, equipment and essentials for natural disaster prevention and control activities under the guidance of the Central Steering Committee for Natural Disaster Prevention and Control and the National Committee for Search and Rescue. |

Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các cấp có trách nhiệm tổ chức thực hiện phương án phòng, chống thiên tai; chủ động chuẩn bị nhân lực, vật tư, phương tiện, trang thiết bị, nhu yếu phẩm phù hợp với phương án ứng phó thiên tai đã được phê duyệt; tổ chức tập huấn, diễn tập theo các phương án phòng, chống thiên tai trên địa bàn. | 3. Thông tin dự báo, cảnh báo thiên tai phải kịp thời, chính xác, phù hợp với nhu cầu của nhiều đối tượng được chuyển tải bằng ngôn ngữ phổ thông (tiếng Việt), đặc biệt quan tâm đến đối tượng dễ bị tổn thương và trong trường hợp cần thiết được chuyển tải bằng ngôn ngữ dân tộc. | 1. Information on natural disaster forecasts and warnings must be timely, accurate and meet the needs of various target groups, and made in a common language (Vietnamese), paying special attention to vulnerable groups and, when necessary, made in ethnic minority languages. |

| a) Bản tin dự báo, cảnh báo thiên tai về khí tượng, thủy văn, hải văn phải bảo đảm thông tin về loại thiên tai, cường độ, cấp độ rủi ro thiên tai, vị trí, tọa độ hiện tại và dự báo diễn biến; | a/ A bulletin on meteorological, hydrographical and oceanographic forecasts and warnings about natural disasters must have information on the type of natural disaster, intensity and level of natural disaster risk, current location and coordinates, and forecast of natural disaster developments; |

| b) Viện Hàn lâm Khoa học và Công nghệ Việt Nam có trách nhiệm ban hành bản tin báo tin động đất và dự báo, cảnh báo sóng thần; | b/ The Vietnam Academy of Science and Technology shall issue bulletins on earthquakes and tsunami forecasts and warnings; |
| c) Các cơ quan quy định tại điểm a và điểm b khoản này gửi các bản tin dự báo, cảnh báo thiên tai đến Đài Truyền hình Việt Nam, Đài Tiếng nói Việt Nam, các cơ quan theo quy định và chịu trách nhiệm về nội dung các dự báo, cảnh báo về thiên tai. | c/ The agencies specified at Points a and b of this Clause shall send bulletins on natural disaster forecasts and warnings to Vietnam Television, the Voice of Vietnam and competent agencies and take responsibility for the contents of natural disaster forecasts and warnings. |
| 4. Đài Truyền hình Việt Nam, Đài Tiếng nói Việt Nam có trách nhiệm truyền, phát tin dự báo và cảnh báo thiên tai của cơ quan quy định tại điểm a và điểm b khoản 3 Điều này. | 4. | Điều 25. Chỉ đạo, chỉ huy ứng phó thiên tai | Article 25. Direction and command of response to natural disasters |
| 1. Căn cứ vào bản tin dự báo, cảnh báo thiên tai, Thủ tướng Chính phủ, Ban chỉ đạo trung ương về phòng, chống thiên tai, Ủy ban quốc gia tìm kiếm cứu nạn, Ban chỉ huy phòng, chống thiên tai các bộ, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh ban hành văn bản chỉ đạo, chỉ huy triển khai thực hiện biện pháp ứng phó thiên tai theo quy định của Chính phủ. | 1. | b) Nội dung của văn bản chỉ đạo, chỉ huy ứng phó thiên tai phải bảo đảm phù hợp với nội dung bản tin dự báo, cảnh báo, thực tế diễn biến thiên tai tại địa phương; biện pháp cơ bản để ứng phó thiên tai và tìm kiếm cứu nạn; | b/ The contents of a document to direct and command response to natural disasters must conform to the contents of the bulletin on natural disaster forecasts and warnings and actual developments of natural disasters in localities; natural disaster response and search and rescue measures; |

| a) Cơ quan có thẩm quyền ban hành văn bản chỉ đạo, chỉ huy ứng phó thiên tai có trách nhiệm gửi văn bản chỉ đạo, chỉ huy đến Đài truyền hình, Đài phát thanh cùng cấp và cơ quan có liên quan theo quy định của pháp luật; | a/ Agencies competent to issue documents to direct and command response to natural disasters shall send such documents to television and radio stations of the same levels and related agencies as prescribed by law; |
| b) Ủy ban nhân dân, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã có trách nhiệm phổ biến nội dung văn bản chỉ đạo, chỉ huy ứng phó thiên tai đến cộng đồng và người dân; | b/ Commune-level People’s Committees and commanding committees for natural disaster prevention and control and search and rescue shall disseminate the contents of documents to direct and command response to natural disasters to the community and people; |

| 4. Chính phủ quy định cụ thể các cơ quan có trách nhiệm truyền tin; tần suất, thời lượng phát tin chỉ đạo, chỉ huy ứng phó thiên tai; mạng lưới thông tin, trang thiết bị phục vụ hoạt động chỉ đạo, chỉ huy ứng phó thiên tai. | 4. The Government shall specifically determine agencies responsible for transmitting information; frequency and time of transmitting information to direct and command response to natural disasters; information networks and equipment serving the direction and command of response to natural disasters. |

| Căn cứ vào loại thiên tai, cấp độ rủi ro thiên tai xảy ra, Ban chỉ đạo trung ương về phòng, chống thiên tai, Ủy ban quốc gia tìm kiếm cứu nạn, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các cấp quyết định lựa chọn một hoặc một số biện pháp phù hợp sau đây: | Based on the types of natural disasters and levels of natural disaster risks, the Central Steering Committee for Natural Disaster Prevention and Control, the National Committee for Search and Rescue and commanding committees for natural disaster prevention and control and search and rescue at all levels shall decide to select one or several of the following measures as appropriate: |

| b) Di chuyển tàu thuyền, phương tiện nuôi trồng thuỷ sản trên biển, ven biển, trên sông ra khỏi khu vực nguy hiểm; tổ chức kiểm đếm, hướng dẫn tàu thuyền neo đậu hoặc thực hiện biện pháp khác để bảo đảm an toàn; | b/ Moving ships, boats and aquaculture facilities at sea, in coastal areas or on rivers out of dangerous areas; tallying and guiding ships and boats to anchor, or taking other measures to assure safety; |

| đ) Kiểm tra, phát hiện và xử lý sự cố công trình phòng, chống thiên tai, công trình trọng điểm về kinh tế - xã hội và an ninh, quốc phòng; | dd/ Checking, detecting and handling incidents at natural disaster prevention and control works and key socio-economic and security and defense works; |
| e) Giám sát, hướng dẫn và chủ động thực hiện việc hạn chế hoặc cấm người, phương tiện đi vào khu vực nguy hiểm trên sông, trên biển, khu vực và tuyến đường bị ngập sâu, khu vực có nguy cơ sạt lở đất do mưa lũ hoặc dòng chảy và khu vực nguy hiểm khác; | e/ Supervising, guiding and proactively restricting or banning people and vehicles from entering dangerous areas on rivers or the sea, deeply inundated areas and roads, areas prone to landslides due to floods or water currents and other dangerous areas; |

| h) Thực hiện hoạt động tìm kiếm cứu nạn, cứu chữa người bị thương, hỗ trợ lương thực, thuốc chữa bệnh, nước uống và nhu yếu phẩm khác tại khu vực bị chia cắt, khu vực ngập lụt nghiêm trọng và địa điểm sơ tán; | h/ Conducting search and rescue, providing First Aid to injured people, and supplying food, curative medicines, drinking water and other essentials for isolated areas, seriously inundated areas and evacuation places; |
| i) Bảo đảm an ninh, trật tự an toàn xã hội, bảo vệ tài sản của Nhà nước và nhân dân tại khu vực xảy ra thiên tai; | i/ Assuring security, social order and safety and protecting properties of the State and people in natural disaster-hit areas; |
| k) Huy động khẩn cấp và tuân thủ quyết định chỉ đạo, huy động khẩn cấp về nhân lực, vật tư, phương tiện, trang thiết bị, nhu yếu phẩm để kịp thời ứng phó với thiên tai. | k/ Urgently mobilizing and complying with decisions on direction and urgent mobilization of manpower, supplies, means, equipment and essentials for timely response to natural disasters. |
| 2. Biện pháp cơ bản ứng phó đối với hạn hán và xâm nhập mặn được quy định như sau: | 2. Basic measures to respond to drought and seawater intrusion are provided as follows: |
| a) Điều chỉnh cơ cấu cây trồng, vật nuôi, mùa vụ phù hợp với dự báo, cảnh báo và tình hình diễn biến hạn hán và xâm nhập mặn; | a/ Adjusting the structures of plants, animals and crops based on forecasts, warnings and developments of drought and seawater intrusion; |
| b) Vận hành hợp lý hồ chứa nước, công trình cấp nước, ưu tiên cấp nước sinh hoạt; sử dụng tiết kiệm, chống thất thoát nước; | b/ Rationally operating reservoirs and water supply works, prioritizing supply of water for residential use; economically using water and preventing water loss; |
| c) Ưu tiên cung cấp điện và vật tư, nhiên liệu cần thiết cho các trạm bơm; | c/ Prioritizing supply of electricity and necessary supplies and fuels for pumping stations; |
| d) Tổ chức quan trắc độ mặn, điều hành đóng mở cống lấy nước và ngăn mặn phù hợp với tình huống cụ thể. | d/ Observing the level of salinity and appropriately regulating the closure and opening of sluices for water collection and salinity prevention in specific circumstances. |

| a) Triển khai biện pháp chống rét cho người, đặc biệt cho đối tượng dễ bị tổn thương; | a/ Taking measures to prevent cold for people, especially vulnerable groups; |
| b) Triển khai chống rét và bảo đảm nguồn thức ăn cho gia súc; | b/ Preventing cold and ensuring sufficient feed for livestock; |
| c) Triển khai biện pháp bảo vệ cây trồng phù hợp. | c/ Taking appropriate measures to protect plants. |
| 4. Biện pháp cơ bản ứng phó đối với động đất, sóng thần được quy định như sau: | 4. Basic measures to respond to earthquakes and tsunamis are provided as follows: |
| a) Chủ động trú, tránh, bảo đảm an toàn khi xảy ra động đất; | a/ Proactively taking shelter, assuring safety when an earthquake occurs; |
| b) Chủ động sơ tán ra khỏi khu vực chịu ảnh hưởng của sóng thần; | b/ Proactively evacuating people from tsunami-affected areas; |
| c) Tổ chức tìm kiếm cứu nạn, cứu chữa người bị thương; | c/ Organizing search and rescue and treatment of injured people; |
| d) Bố trí nơi ở tạm, hỗ trợ lương thực, thuốc chữa bệnh, nước uống, nhu yếu phẩm khác cho người dân bị ảnh hưởng; | d/ Arranging temporary accommodation and providing food, curative medicines, drinking water and other essentials for affected people; |
| đ) Bảo đảm an ninh, trật tự an toàn xã hội, bảo vệ tài sản của Nhà nước và nhân dân tại khu vực xảy ra thiên tai. | dd/ Assuring security, social order and safety and protecting properties of the State and people in natural disaster-hit areas. |
| 5. Đối với nắng nóng, lốc, sét, mưa đá và các loại thiên tai khác thì căn cứ vào dự báo, cảnh báo, tính chất và diễn biễn thực tế của từng loại thiên tai, chủ động triển khai biện pháp ứng phó phù hợp với tình huống cụ thể. | 5. For extreme hot weather, whirlwinds, lightning, hail and other types of natural disaster, based on forecasts, warnings, characteristics and actual developments of each type of natural disaster, proactively taking appropriate response measures in specific circumstances. |
| Điều 27. Trách nhiệm trong ứng phó thiên tai | Article 27. Responsibilities in natural disaster response |
| 1. Căn cứ vào dự báo, cảnh báo, cấp độ rủi ro thiên tai đối với từng loại thiên tai, Ban chỉ đạo trung ương về phòng, chống thiên tai có trách nhiệm theo dõi tình hình thiên tai; chỉ đạo bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, địa phương thực hiện biện pháp ứng phó thiên tai và điều phối hoạt động ứng phó thiên tai liên ngành với phạm vi cấp vùng từ hai tỉnh trở lên; hỗ trợ địa phương trong trường hợp vượt quá khả năng; báo cáo Thủ tướng Chính phủ về tình hình thiên tai và hoạt động ứng phó thiên tai. | 1. | a) Quyết định lựa chọn phương án và biện pháp ứng phó thiên tai; | a/ Decide to select natural disaster response plans and measures; |
| b) Tổ chức thực hiện biện pháp ứng phó thiên tai bảo đảm an toàn công trình và hoạt động trong lĩnh vực thuộc phạm vi quản lý. Trường hợp vượt quá khả năng ứng phó phải báo cáo Ban chỉ đạo trung ương về phòng, chống thiên tai và Ủy ban quốc gia tìm kiếm cứu nạn để phối hợp chỉ đạo ứng phó thiên tai; | b/ Take natural disaster response measures to assure safety for works and activities in the fields under their management; report cases which fall beyond their capacity to the Central Steering Committee for Natural Disaster Prevention and Control and the National Committee for Search and Rescue for coordinated direction in response to natural disasters; |

| 4. Căn cứ vào dự báo, cảnh báo, cấp độ rủi ro thiên tai, diễn biến thiên tai, sự chỉ đạo, chỉ huy của Ban chỉ đạo trung ương về phòng, chống thiên tai và Ủy ban quốc gia tìm kiếm cứu nạn, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp trên, trong phạm vi nhiệm vụ và quyền hạn của mình, Ủy ban nhân dân, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các cấp có trách nhiệm sau đây: | 4. Based on forecasts, warnings, levels of natural disaster risks, developments of natural disasters, and the direction and command of the Central Steering Committee for Natural Disaster Prevention and Control, the National Committee for Search and Rescue and superior commanding committees for natural disaster prevention and control and search and rescue within the scope of their tasks and powers, local People’s Committees and commanding committees for natural disaster prevention and control and search and rescue shall: |
| a) Quyết định lựa chọn phương án, biện pháp và tổ chức thực hiện ứng phó phù hợp với diễn biến thiên tai và điều kiện thực tế của địa bàn; | a/ Decide to select response plans and measures and organize response activities suitable to the developments of natural disasters and local practical conditions; |
| b) Chỉ đạo cơ quan chức năng tổng hợp và báo cáo kịp thời tình hình thiệt hại do thiên tai gây ra và chịu trách nhiệm về tính chính xác của thông tin, số liệu thiệt hại; | b/ Direct functional agencies in summarizing and promptly reporting on damage caused by natural disasters and take responsibility for the accuracy of information and data on the damage; |
| c) Trường hợp vượt quá khả năng, phải báo cáo Ủy ban nhân dân hoặc cơ quan chỉ đạo, chỉ huy phòng, chống thiên tai cấp trên. | c/ Report cases which fall beyond their capacity to superior People’s Committees or agencies in charge of directing and commanding natural disaster prevention and control. |
| 5. Lực lượng vũ trang nhân dân có trách nhiệm ứng phó thiên tai theo sự điều động của cơ quan có thẩm quyền. | 5. People’s armed forces shall respond to natural disasters as mobilized by competent agencies. |
| 6. Tổ chức, hộ gia đình, cá nhân có trách nhiệm chủ động thực hiện biện pháp ứng phó thiên tai và tham gia ứng phó thiên tai theo sự điều động của cơ quan có thẩm quyền. | 6. Organizations, households and individuals shall take the initiative in taking natural disaster response measures and participate in natural disaster response as mobilized by competent agencies. |
| 7. Căn cứ vào các cấp độ rủi ro thiên tai và loại thiên tai cụ thể, các lực lượng tham gia ứng phó thiên tai trên cùng địa bàn phải phối hợp chặt chẽ theo sự chỉ đạo, chỉ huy của người có thẩm quyền để thực hiện biện pháp ứng phó thiên tai. | 7. Based on the levels of natural disaster risks and types of natural disaster, forces participating in natural disaster response in the same locality shall coordinate closely with one another under the direction and command of competent persons in taking natural disaster response measures. |
| 8. Chính phủ quy định việc phân công, phân cấp trách nhiệm và phối hợp trong ứng phó thiên tai phù hợp với cấp độ rủi ro thiên tai. | 8. The Government shall define the assignment and decentralization of responsibilities and coordination in natural disaster response suitable to the levels of natural disaster risks. |
| Điều 28. Thẩm quyền huy động nguồn lực phục vụ hoạt động ứng phó thiên tai | Article 28. Competence to mobilize resources for natural disaster response activities |
| 1. Trưởng Ban chỉ đạo trung ương về phòng, chống thiên tai quyết định huy động hoặc báo cáo, đề xuất Thủ tướng Chính phủ quyết định huy động nguồn lực và biện pháp ứng phó thiên tai trong trường hợp vượt quá khả năng của địa phương, bộ, cơ quan ngang bộ. | 4. The Chairman of the Central Steering Committee for Natural Disaster Prevention and Control may mobilize or shall report and propose the Prime Minister to mobilize resources and measures to respond to natural disasters in cases which fall beyond the capacity of localities, ministries or ministerial- level agencies. |
| 5. Người có thẩm quyền quyết định huy động lực lượng, vật tư, phương tiện, trang thiết bị, nhu yếu phẩm có trách nhiệm quyết định việc hoàn trả hoặc bồi thường thiệt hại cho tổ chức, hộ gia đình, cá nhân được huy động theo quy định của Luật này, pháp luật có liên quan và chịu trách nhiệm về quyết định của mình. | 5. Persons competent to mobilize manpower, supplies, means, equipment and essentials shall decide to return mobilized supplies, vehicles, equipment and essentials to or to pay compensations to their owners in accordance with this Law and relevant laws, and shall take responsibility for their decisions. |
| Điều 29. Hoạt động tìm kiếm, cứu nạn trong ứng phó thiên tai | Article 29. Search and rescue activities in natural disaster response |
| 1. Hoạt động tìm kiếm và cứu nạn người gặp nguy hiểm tại khu vực có thiên tai xảy ra bao gồm: | 1. Search and rescue activities for people facing danger in natural disaster-hit areas include: |
| a) Sơ tán người ra khỏi nơi nguy hiểm, ưu tiên đối tượng dễ bị tổn thương; | a/ Evacuating people from dangerous places, giving priority to vulnerable groups; |
| b) Cấp cứu kịp thời người gặp nguy hiểm; tìm kiếm người, phương tiện mất tích; | b/ Promptly giving emergency relief to people facing danger; searching for missing people and vehicles; |
| c) Lập các trạm cấp cứu tạm thời hoặc trưng dụng có thời hạn trụ sở cơ quan, trường học, cơ sở y tế tại khu vực có thiên tai để tiếp nhận cấp cứu người bị nạn; | c/ Building temporary emergency stations or requisitioning for a definite time working offices, schools and health establishments in natural disaster-hit areas to receive and provide First Aid to injured people |
| d) Huy động người, vật tư, trang thiết bị, thuốc chữa bệnh để tham gia cứu chữa người bị nạn; | d/ Mobilizing manpower, supplies, equipment and curative medicines to rescue and treat injured people; |
| đ) Dựng các lán trại tạm thời cho người dân bị mất nhà ở; | dd/ Building temporary tents for displaced people; |
| e) Cấp phát lương thực, thực phẩm, thuốc chữa bệnh, nước sạch và nhu yếu phẩm thiết yếu; | e/ Providing food, curative medicines, clean water and essentials; |
| g) | g/ Taking other necessary measures suitable to the characteristics of natural disasters in localities and regions. |
| 2. Trách nhiệm tìm kiếm cứu nạn được quy định như sau: | 2. The search and rescue responsibility is provided as follows: |
| a) Tổ chức, cá nhân chủ động tìm kiếm cứu nạn và có trách nhiệm tham gia tìm kiếm cứu nạn theo sự huy động của cơ quan có thẩm quyền; | a/ Organizations and individuals shall take the initiative and participate in search and rescue activities as mobilized by competent agencies; |
| b) Ủy ban nhân dân, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn địa phương các cấp có trách nhiệm chủ động triển khai hoạt động tìm kiếm cứu nạn trên địa bàn; trường hợp vượt quá khả năng phải báo cáo, đề nghị Ủy ban nhân dân, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp trên hoặc Ban chỉ đạo trung ương về phòng, chống thiên tai và Ủy ban quốc gia tìm kiếm cứu nạn hỗ trợ; | b/ Local People’s Committees and commanding committees for natural disaster prevention and control and search and rescue at all levels, shall take the initiative in organizing search and rescue activities in localities; and report cases, which fall beyond their capacity, to superior People’s Committees and commanding committees for natural disaster prevention and control and search and rescue or the Central Steering Committee for Natural Disaster Prevention and Control and the National Committee for Search and Rescue for support; |

| d) Các đơn vị chuyên trách, kiêm nhiệm làm nhiệm vụ tìm kiếm cứu nạn tại một số bộ có trách nhiệm tổ chức thực hiện tìm kiếm cứu nạn theo sự chỉ đạo của Ủy ban quốc gia tìm kiếm cứu nạn; | d/ Full-time or part-time search and rescue units in some ministries shall organize search and rescue activities as directed by the National Committee for Search and Rescue; |
| đ) Ủy ban quốc gia tìm kiếm cứu nạn có trách nhiệm chỉ đạo, tổ chức phối hợp thực hiện công tác tìm kiếm cứu nạn trong phạm vi cả nước; chủ trì phối hợp với lực lượng hỗ trợ của quốc tế và khu vực trong tìm kiếm cứu nạn. | dd/ The National Committee for Search and Rescue shall direct and organize coordination in search and rescue activities nationwide; assume the prime responsibility for, and coordinate with international and regional relief forces in, search and rescue activities. |

| a) Tiếp tục triển khai công tác tìm kiếm cứu nạn, cứu trợ, hỗ trợ lương thực, thực phẩm, thuốc chữa bệnh, nhu yếu phẩm thiết yếu khác và hỗ trợ tâm lý để ổn định đời sống của người dân; | a/ Continuing to organize search and rescue work and provide relief, food, curative medicines and other essentials as well as psychological assistance to stabilize people’s lives; |
| b) Thống kê, đánh giá thiệt hại do thiên tai gây ra, nhu cầu cứu trợ, hỗ trợ và đề xuất phương án khắc phục hậu quả; | b/ Making statistics of and assessing damage caused by natural disasters, needs for relief and support, and proposing plans to remedy consequences; |
| c) Hỗ trợ giống cây trồng, vật nuôi, vật tư, trang thiết bị, nhiên liệu thiết yếu khác để phục hồi sản xuất; | c/ Providing plant varieties, animal breeds, supplies, equipment and essential fuels to restore production; |
| d) Cung ứng vật tư, hàng hóa thiết yếu và thực hiện biện pháp quản lý giá, bình ổn thị trường; | d/ Providing supplies and essential commodities and taking price management and market stabilization measures; |
| đ) Thực hiện vệ sinh môi trường, phòng chống dịch bệnh ở khu vực bị tác động của thiên tai; | dd/ Assuring environmental sanitation, and preventing and controlling epidemics in areas affected by natural disasters; |
| e) Sửa chữa, khôi phục, nâng cấp công trình phòng, chống thiên tai, giao thông, thông tin, thủy lợi, điện lực, trường học, cơ sở y tế và công trình hạ tầng công cộng; tổ chức tuyên truyền nâng cao nhận thức và năng lực của cộng đồng về phòng, chống thiên tai. | e/ Repairing, restoring and upgrading natural disaster prevention and control works, transport, communication, irrigation and power works, schools, health establishments and public infrastructure facilities; conducting public information to raise community awareness and capacity of natural disaster prevention and control. |
| 2. Trách nhiệm thực hiện hoạt động khắc phục hậu quả thiên tai được quy định như sau: | 2. The responsibility to remedy natural disaster consequences is provided as follows: |
| a) Tổ chức, hộ gia đình, cá nhân có trách nhiệm chủ động khắc phục hậu quả thiên tai đối với cơ sở hạ tầng, tài sản thuộc phạm vi quản lý; tham gia hỗ trợ hoạt động khắc phục hậu quả thiên tai theo sự huy động của cơ quan có thẩm quyền; | a/ Organizations, households and individuals shall take the initiative in remedying natural disaster consequences with regard to infrastructure facilities and properties under their management; participate in and support the remediation of natural disaster consequences as mobilized by competent agencies; |
| b) Ủy ban nhân dân, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các cấp có trách nhiệm tổ chức thực hiện công tác khắc phục hậu quả thiên tai trên địa bàn theo quy định tại khoản 1 Điều này; | b/ Local People’s Committees and commanding committees for natural disaster prevention and control and search and rescue at all levels shall organize remediation of natural disaster consequences in localities according to Clause 1 of this Article; |
| c) Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ có trách nhiệm chủ động khắc phục hậu quả thiên tai trong phạm vi quản lý và tham gia khắc phục hậu quả thiên tai khi có yêu cầu; | c/ Ministries, ministerial-level agencies and government-attached agencies shall take the initiative in remedying natural disaster consequences within the scope of their management and participate in remedying natural disaster consequences upon request; |
| d) Ban chỉ đạo trung ương về phòng, chống thiên tai có trách nhiệm tổng hợp báo cáo đánh giá thiệt hại và nhu cầu cứu trợ, hỗ trợ từ các địa phương và các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ; chỉ đạo công tác khắc phục hậu quả thiên tai và báo cáo Chính phủ về biện pháp và nguồn lực để hỗ trợ khắc phục hậu quả thiên tai. | d/ The Central Steering Committee for Natural Disaster Prevention and Control shall summarize damage assessment reports and needs for relief and support from localities, ministries, ministerial-level agencies and government- attached agencies; direct the remediation of natural disaster consequences and report on measures and resources to support the remediation of natural disaster consequences to the Government. |
| Điều 31. Trách nhiệm thống kê, đánh giá thiệt hại do thiên tai | Article 31. Responsibilities to make statistics of and assess damage caused by natural disasters |
| 1. Tổ chức, cá nhân có trách nhiệm báo cáo chính xác thiệt hại do thiên tai gây ra trong phạm vi quản lý với Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã, cơ quan chủ quản. | 1. Organizations and individuals shall accurately report on damage caused by natural disasters in the scope of their management to commune-level commanding committees for natural disaster prevention and control and search and rescue and their managing agencies. |
| 2. Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các cấp có trách nhiệm tổng hợp thiệt hại do thiên tai gây ra, báo cáo Ủy ban nhân dân cùng cấp và Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp trên. Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh báo cáo Ban chỉ đạo trung ương về phòng, chống thiên tai để phục vụ công tác chỉ đạo. | 2. The commanding committees for natural disaster prevention and control and search and rescue at all levels, shall summarize damage caused by natural disasters and report it to the People’s Committees of the same level and superior commanding committees for natural disaster prevention and control and search and rescue. Provincial-level commanding committees for natural disaster prevention and control and search and rescue shall report damage caused by natural disasters to the Central Steering Committee for Natural Disaster Prevention and Control to direct work. |
| 3. Ủy ban nhân dân các cấp có trách nhiệm tổng hợp, thống kê, đánh giá thiệt hại; kiểm tra kết quả đánh giá thiệt hại do thiên tai gây ra và báo cáo Ủy ban nhân dân cấp trên. People’s Committees at all levels shall summarize, make statistics of, and assess damage caused by natural disasters; examine damage assessment results and report them to superior People’s Committees. Provincial-level People’s Committees shall send reports on damage caused by natural disasters to the Prime Minister, and concurrently to the Ministry of Agriculture and Rural Development for summarization. |

Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ có trách nhiệm tổng hợp, thống kê, đánh giá thiệt hại do thiên tai gây ra trong phạm vi quản lý và báo cáo Thủ tướng Chính phủ; đồng thời gửi Bộ Nông nghiệp và Phát triển nông thôn để tổng hợp. | 5. Ministries, ministerial-level agencies and government-attached agencies shall summarize, make statistics of, and assess damage caused by natural disasters within the scope of their management and report them to the Prime Minister and concurrently to the Ministry of Agriculture and Rural Development for summarization. |
| 6. Bộ Nông nghiệp và Phát triển nông thôn tổng hợp và đánh giá thiệt hại do thiên tai gây ra trong phạm vi cả nước báo cáo Thủ tướng Chính phủ và công bố số liệu về thiệt hại do thiên tai gây ra. | 6. The Ministry of Agriculture and Rural Development shall summarize and assess damage caused by natural disasters nationwide, report such damage to the Prime Minister and publicize data on damage caused by natural disasters. |
| 7. Bộ Nông nghiệp và Phát triển nông thôn chủ trì, phối hợp với Bộ Kế hoạch và Đầu tư hướng dẫn việc thống kê, đánh giá thiệt hại do thiên tai gây ra. | 7. The Ministry of Agriculture and Rural Development shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment in, guiding the making of statistics and assessment of damage caused by natural disasters. |
| Điều 32. Hình thức, đối tượng và nguồn lực cứu trợ, hỗ trợ | Article 32. Forms, beneficiaries of, and resources for relief and support |
| 1. Cứu trợ khẩn cấp được quy định như sau: | 1. Emergency relief is provided as follows: |
| a) Cứu trợ khẩn cấp được thực hiện trong và ngay sau khi thiên tai xảy ra, tập trung vào thực hiện hoạt động hỗ trợ lương thực, thực phẩm, thuốc chữa bệnh và nhu yếu phẩm thiết yếu khác để ổn định đời sống của người dân, vệ sinh môi trường, phòng chống dịch bệnh ở khu vực bị tác động của thiên tai; | a/ Emergency relief is provided right after natural disasters occur and during natural disasters, focusing on the provision of food, curative medicines and other essentials to stabilize people’s lives, clean the environment and prevent and control epidemics in areas affected by natural disasters; |
| b) Đối tượng được cứu trợ bao gồm cá nhân bị thương, hộ gia đình có người bị chết; hộ gia đình, cá nhân bị mất nhà ở, không có lương thực, nước uống và nhu yếu phẩm khác có nguy cơ ảnh hưởng tới tính mạng và sức khỏe, đặc biệt quan tâm tới đối tượng dễ bị tổn thương; | b/ Relief beneficiaries include injured persons and households of dead persons; households and individuals that lose their homes, have no food, drinking water and other essentials and face life and health risks, paying special attention to vulnerable groups; |
| c) Nguồn lực cho cứu trợ khẩn cấp bao gồm lương thực, hàng hóa, thuốc chữa bệnh, hóa chất xử lý nước và môi trường thuộc dự trữ quốc gia; kinh phí dự phòng hằng năm từ ngân sách nhà nước; Quỹ phòng, chống thiên tai và đóng góp tự nguyện của tổ chức, cá nhân. | c/ Resources for relief include food, commodities, curative medicines, water and environment treatment chemicals from the national reserves; annual state budget provisions; the natural disaster prevention fund; and voluntary contributions of organizations and individuals. |
| 2. Hỗ trợ trung hạn được quy định như sau: | 2. Medium-term support is provided as follows: |
| a) Hỗ trợ trung hạn được thực hiện tiếp theo cứu trợ khẩn cấp, tập trung vào hỗ trợ giống cây trồng, vật nuôi, vật tư, trang thiết bị, nhiên liệu thiết yếu khác để phục hồi sản xuất; cung ứng vật tư, hàng hóa thiết yếu và thực hiện các biện pháp quản lý giá, bình ổn thị trường; sửa chữa, khôi phục trụ sở, công trình phòng, chống thiên tai, giao thông, thông tin, thủy lợi, cấp nước sinh hoạt, điện lực, trường học, cơ sở y tế và công trình hạ tầng thiết yếu khác bị thiệt hại; | a/ Medium-term support is provided following emergency relief, focuses on the provision of plant varieties, animal breeds, supplies, equipment and essential fuels for the restoration of production; provision of supplies and essential commodities and the application of price management and market stabilization measures; repair and restoration of damaged buildings, natural disaster prevention and control works, transport, communication, irrigation, water supply and power works, schools, health establishments and other essential infrastructure facilities; |
| b) Đối tượng được hỗ trợ trung hạn bao gồm tổ chức, cá nhân sản xuất nông nghiệp bị thiệt hại; cơ quan nhà nước, đơn vị lực lượng vũ trang; đơn vị sự nghiệp và doanh nghiệp có công trình quy định tại điểm a khoản này; | b/ Beneficiaries of medium-term support include farming organizations and farmers suffering from damage; state agencies, armed forces units; non- business units and enterprises having works specified at Point a of this Clause; |
| c) Nguồn lực cho hỗ trợ trung hạn bao gồm lương thực, hàng hóa dự trữ của Nhà nước; kinh phí dự phòng hằng năm từ ngân sách nhà nước; Quỹ phòng, chống thiên tai và đóng góp tự nguyện của tổ chức, cá nhân. | c/ Resources for medium-term support include food and commodities from the state reserves; annual state budget provisions; the natural disaster prevention and control fund; and voluntary contributions of organizations and individuals. |
| 3. Hỗ trợ dài hạn được quy định như sau: | 3. Long-term support is provided as follows: |
| a) Hỗ trợ dài hạn được thực hiện tiếp theo hỗ trợ trung hạn, tập trung vào việc sửa chữa, khôi phục, nâng cấp công trình phòng, chống thiên tai, giao thông, công trình hạ tầng công cộng; tuyên truyền nâng cao nhận thức và năng lực của cộng đồng về phòng, chống thiên tai; | Long-term support is provided following medium-term support, focuses on the repair, restoration and upgrading of natural disaster prevention and control works, transport and public infrastructure facilities; and public information to raise community awareness and capacity of natural disaster prevention and control; |
| b) Đối tượng được hỗ trợ dài hạn bao gồm tổ chức, cá nhân, cơ quan nhà nước, đơn vị sự nghiệp và doanh nghiệp hoạt động công ích bị thiệt hại do thiên tai gây ra; | b/ Beneficiaries of long-term support include organizations, individuals, state agencies, non-business units and public-utility enterprises suffering from damage caused by natural disasters; |
| c) Nguồn lực cho hỗ trợ dài hạn bao gồm ngân sách nhà nước và đóng góp tự nguyện của tổ chức, cá nhân; | c/ Resources for long-term support include state budget funds and voluntary contributions of organizations and individuals; |
| d) Ủy ban nhân dân các cấp căn cứ vào tình hình thiệt hại và mức độ thiên tai ở địa phương xây dựng kế hoạch, bố trí nguồn lực thực hiện. | d/ People’s Committees at all levels shall base themselves on the situation of damage and natural disasters in localities to work out support plans and allocate resources for implementation. |
| Điều 33. Huy động, quyên góp và phân bổ nguồn lực cứu trợ, hỗ trợ | Article 33. Mobilization, fundraising and allocation of resources for relief and support |
| 1. Nguyên tắc huy động, quyên góp và phân bổ nguồn lực cứu trợ, hỗ trợ được quy định như sau: | 1. The mobilization, fundraising and allocation of resources for relief and support must adhere to the following principles: |
| a) Việc huy động, quyên góp và phân bổ nguồn lực cứu trợ, hỗ trợ phải tuân theo quy định của pháp luật, căn cứ vào mức độ thiệt hại, chia sẻ thông tin và phối hợp với chính quyền địa phương nơi có đối tượng được hỗ trợ để bảo đảm công bằng, công khai và tránh trùng lặp; | a/ Complying with the law, being based on the extent of damage, sharing information and coordinating with the administrations of localities, providing relief and support to beneficiaries to assure equality and publicity and avoid duplication of relief and support for the same beneficiaries; |
| b) Việc cứu trợ cần tập trung đáp ứng nhu cầu thiết yếu của người dân bị ảnh hưởng bởi thiên tai, đặc biệt là đối tượng dễ bị tổn thương. | b/ Concentrating relief on meeting essential needs of people affected by natural disasters, especially vulnerable groups. |
| 2. Thẩm quyền huy động, quyên góp và phân bổ nguồn lực cứu trợ, hỗ trợ được quy định như sau: | 2. The competence to mobilize, collect and allocate resources for relief and support is provided as follows: |

| đ) Người tham gia ứng phó thiên tai nếu bị thương, bị chết được xem xét, hưởng chế độ, chính sách như đối với thương binh, liệt sỹ theo quy định của pháp luật về ưu đãi người có công với cách mạng; | dd/ Participants in the response to natural disasters, who are injured or killed may be considered for entitlements and policies applicable to fallen heroes or war invalids as provided by the law on preferential treatment of persons with meritorious service to the revolution; |
| e) Được cứu trợ, hỗ trợ khi bị thiệt hại do thiên tai theo quy định của pháp luật. | e/ To receive relief and support in accordance with law when suffering from damage caused by natural disasters. |

| a) Chủ động xây dựng, nâng cấp, bảo vệ công trình, nhà ở thuộc quyền sở hữu của mình bảo đảm an toàn trước thiên tai hoặc di dời đến nơi an toàn; không xây dựng nhà ở hoặc cư trú tại khu vực có thể bị ảnh hưởng nghiêm trọng bởi thiên tai; | a/ To take the initiative in building, upgrading and protecting their works and houses to assure safety during natural disasters or remove them to safe places; neither to build houses nor to reside in areas, which can be severely affected by natural disasters; |
| b) Thực hiện kế hoạch phòng, chống thiên tai, phương án ứng phó thiên tai tại địa phương; | b/ To implement local plans on natural disaster prevention and control and plans on response to natural disasters; |
| c) Tổ chức sản xuất, kinh doanh phù hợp với đặc điểm thiên tai tại địa phương; | c/ To organize production and business activities suitable to the characteristics of natural disasters in their localities; |
| d) Chủ động trang bị thiết bị theo khả năng để tiếp nhận bản tin dự báo, cảnh báo và sự chỉ đạo, hướng dẫn phòng, chống thiên tai; | d/ To take the initiative in procuring equipment within their capacity to receive natural disaster forecasts and warnings and natural disaster prevention and control instructions; |
| đ) Chuẩn bị sẵn sàng vật tư, phương tiện theo khả năng để phòng, chống thiên tai; | dd/ To prepare supplies and means within their capacity for natural disaster prevention and control; |
| e) Chủ động dự trữ lương thực, nước uống, vật tư và thiết bị xử lý nước, thuốc chữa bệnh, thuốc phòng dịch theo khả năng để bảo đảm đời sống khi thiên tai xảy ra phù hợp với đặc thù thiên tai tại địa phương; | e/ To take initiative in reserving food, drinking water, supplies and equipment for water treatment, curative medicines and medicines for epidemic prevention suitable to local natural disaster characteristics within their capacity, in order to sustain their livelihoods when natural disasters occur; |
| g) Chủ phương tiện, tàu thuyền hoạt động trên biển, trên sông phải trang bị đầy đủ phao cứu sinh, thiết bị thông tin, tín hiệu phù hợp; phải cung cấp thông tin kịp thời, chính xác về vị trí, tình trạng của phương tiện đang hoạt động cho chính quyền địa phương, cơ quan chức năng khi thiên tai xảy ra; khi gặp tàu thuyền khác bị nạn phải kịp thời cứu hộ, tìm kiếm, cứu nạn, trường hợp vượt quá khả năng phải bằng mọi cách thông báo cho cơ quan tìm kiếm, cứu nạn; | g/ Owners of ships and boats operating on the sea and rivers shall fully equip appropriate lifebuoys and communication and signaling devices; promptly provide accurate information on their position and the state of their operating means to local administrations and functional agencies when natural disasters occur; when encountering other ships and boats in distress, they shall promptly render salvation, search and rescue, or notify such by all means to the search and rescue agency in case the incident is beyond their capacity; |
| h) Chủ động ứng phó, khắc phục hậu quả nhằm bảo đảm an toàn cho bản thân và gia đình khi thiên tai xảy ra; tham gia hỗ trợ cộng đồng phòng, chống thiên tai; | h/ To take the initiative in responding to and remedying consequences of natural disasters to assure safety for themselves and their families; to participate in assisting the community in natural disaster prevention and control; |
| i) Chấp hành sự hướng dẫn, chỉ đạo, chỉ huy của cơ quan, người có thẩm quyền về sơ tán người, phương tiện ra khỏi hoặc không đi vào khu vực nguy hiểm; | i/ To comply with instructions and commands of competent agencies and persons on evacuation of people and means from, or no entry, into dangerous areas; |
| k) Chấp hành quyết định huy động nhân lực, vật tư, phương tiện, trang thiết bị, nhu yếu phẩm để phục vụ hoạt động ứng phó khẩn cấp của cơ quan có thẩm quyền; | k/ To comply with decisions of competent agencies on the mobilization of manpower, supplies, means, equipment and essentials to serve the urgent response to natural disasters; |
| l) Chủ động thực hiện vệ sinh môi trường, phòng chống dịch bệnh trong khu vực sinh sống và làm việc sau khi bị tác động của thiên tai; | l/ To take the initiative in conducting environmental sanitation and epidemic and disease prevention and control in their living and working areas affected by natural disasters; |
| m) Thông báo đến cơ quan, người có thẩm quyền khi phát hiện sự cố hoặc hành vi gây mất an toàn cho công trình phòng, chống thiên tai và tham gia xử lý sự cố công trình trong khả năng của mình; | m/ To notify to competent agencies and persons upon detecting incidents or acts, which make natural disaster prevention and control works unsafe, and participate in the handling of such incidents within their capacity; |
| n) Cung cấp thông tin về diễn biến thiên tai, thiệt hại do thiên tai cho cơ quan có thẩm quyền trong phạm vi nhận biết của mình; | n/ To provide information within their knowledge on developments and consequences of natural disasters to competent agencies; |
| o) Cá nhân có nghĩa vụ đóng góp vào Quỹ phòng, chống thiên tai theo quy định của Chính phủ; chủ động giúp đỡ người bị thiệt hại do thiên tai tại địa phương. | o/ Individuals are obliged to make contributions to the natural disaster prevention and control fund under the regulations of the Government; and to take the initiative in helping people affected by natural disaster in their localities. |

| a) Được trả công lao động, hoàn trả hoặc bồi thường vật tư, phương tiện, trang thiết bị tham gia ứng phó khẩn cấp thiên tai đối với cộng đồng theo lệnh huy động của cơ quan, người có thẩm quyền; | a/ To be entitled to remunerations, return of or compensations for supplies, means and equipment involved in the urgent response to natural disasters in the community under mobilization orders of competent agencies or persons; |
| b) Tham gia đầu tư dự án xây dựng công trình phòng, chống thiên tai kết hợp đa mục tiêu theo quy hoạch, kế hoạch của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, địa phương và được khai thác lợi ích do việc đầu tư mang lại theo quy định của pháp luật. | b/ To invest in projects on building multi-purpose natural disaster prevention and control works under master plans and plans of ministries, ministerial- level agencies, government-attached agencies and localities, and may enjoy benefits from such investment in accordance with law. |

| a) Chủ động xây dựng, bảo vệ công trình, cơ sở vật chất của mình và tổ chức sản xuất, kinh doanh bảo đảm an toàn trước thiên tai; | a/ To take the initiative in building and protecting their works and physical foundations and assure safety for their production and business activities during natural disasters; |
| b) Xây dựng và tổ chức thực hiện phương án phòng, chống thiên tai; | b/ To elaborate and implement natural disaster prevention and control plans; |
| c) Khi đầu tư xây dựng công trình phải áp dụng quy chuẩn kỹ thuật quốc gia về an toàn trước rủi ro thiên tai; chấp hành quy định về bảo vệ công trình phòng, chống thiên tai; | c/ To apply national technical regulations on safety against natural disaster risks in building works; to observe regulations on protection of natural disaster prevention and control works; |
| d) Tham gia chương trình thông tin, truyền thông, giáo dục về phòng, chống thiên tai; nâng cao kiến thức về phòng, chống thiên tai; tập huấn, huấn luyện, diễn tập kỹ năng phòng, chống thiên tai theo kế hoạch của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và địa phương; | d/ To participate in programs on communication, information and education about natural disaster prevention and control; to improve knowledge about natural disaster prevention and control; to organize training and drills in natural disaster prevention and control skills under plans of ministries, ministerial-level agencies, government-attached agencies and localities; |

| e) Chấp hành lệnh huy động khẩn cấp nhân lực, vật tư, phương tiện, trang thiết bị, nhu yếu phẩm để phục vụ hoạt động ứng phó tình huống khẩn cấp; | e/ To obey orders on urgent mobilization of manpower, supplies, means, equipment and essentials in response to emergency circumstances; |

| Điều 37. Quyền và nghĩa vụ của tổ chức nước ngoài, tổ chức quốc tế đang hoạt động tại Việt Nam | Article 37. Rights and obligations of foreign organizations and individuals and international organizations operating in Vietnam |
| 1. Tổ chức nước ngoài, tổ chức quốc tế đang hoạt động tại Việt Nam khi tham gia hoạt động phòng, chống thiên tai có các quyền được quy định tại khoản 1 Điều 36 của Luật này. | 1. When participating in natural disaster prevention and control, foreign organizations and international organizations operating in Vietnam have the rights provided in Clause 1, Article 36 of this Law. |

| 5. Ủy ban quốc gia tìm kiếm cứu nạn chủ trì, phối hợp với bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ có liên quan thực hiện hợp tác quốc tế trong lĩnh vực tìm kiếm cứu nạn. | 5. The National Committee for Search and Rescue shall assume the prime responsibility for, and coordinate with related ministries, ministerial-level agencies and government-attached agencies in, conducting international cooperation in search and rescue. |

| a) Được miễn thuế, lệ phí về nhập khẩu, xuất khẩu đối với phương tiện, trang thiết bị, hàng hóa phục vụ hoạt động cứu trợ khẩn cấp, tìm kiếm cứu nạn, cứu trợ, hỗ trợ thiên tai; | a/ To be exempted from import and export duties and fees for means, equipment and goods serving emergency relief, search and rescue, relief and support for people affected by natural disaster; |

| c) Tổ chức lập quy hoạch, kế hoạch sản xuất nông nghiệp để hạn chế thiệt hại do thiên tai gây ra và bảo đảm phát triển bền vững; | c/ To elaborate master plans and plans on agricultural production so as to limit damage caused by natural disasters and assure sustainable development; |
| d) Quản lý việc đầu tư xây dựng, tu bổ, bảo vệ công trình phòng, chống thiên tai theo sự phân công của Chính phủ, bao gồm công trình đê điều, hồ đập, chống úng, chống hạn, chống sạt lở; khu neo đậu tránh trú bão cho tàu thuyền và công trình khác phục vụ phòng, chống thiên tai; | d/ To manage the construction, repair, consolidation and protection of natural disaster prevention and control works, including dikes, dams, reservoirs, anti- flood, anti-inundation and anti-erosion works, storm shelters for ships and boats, and other facilities serving natural disaster prevention and control, as assigned by the Government; |

| h) Đầu mối hợp tác quốc tế về phòng, chống thiên tai, đề xuất việc ký kết, gia nhập điều ước quốc tế về phòng, chống thiên tai; | h/ To act as the focal point for international cooperation in natural disaster prevention and control, and propose the conclusion of or accession to, treaties on natural disaster prevention and control; |
| i) Kiểm tra, thanh tra, giải quyết khiếu nại, tố cáo, xử lý vi phạm pháp luật về phòng, chống thiên tai theo thẩm quyền. | i/ To examine, inspect, settle complaints and denunciations, and handle violations of the law on natural disaster prevention and control according to its competence. |

| b) Lập quy hoạch, kế hoạch và chỉ đạo thực hiện việc dự báo khí tượng, thủy văn, hải văn; | b/ To elaborate master plans and plans on and direct the performance of meteorological, hydrographical and oceanographic forecast; |

| c) Lập phương án bố trí lực lượng, phương tiện sẵn sàng tham gia hộ đê, hộ đập, phân lũ, làm chậm lũ, tìm kiếm cứu nạn; | c/ To work out plans on deployment of manpower and means ready for the protection of dikes and dams, flood diversion and slowing, search and rescue; |
| d) Tổ chức thu thập thông tin có liên quan đến thiên tai, chỉ đạo thực hiện ứng cứu, xử lý các tình huống khẩn cấp và khắc phục hậu quả thiên tai; | d/ To collect information relating to natural disasters and direct the response to and handling of emergencies and remediation of natural disaster consequences; |

| b) Lập kế hoạch và phương án bảo đảm an ninh, trật tự an toàn xã hội khi có thiên tai xảy ra, phối hợp với Bộ Quốc phòng, các bộ, cơ quan ngang bộ, địa phương tham gia cứu hộ, cứu nạn và khắc phục hậu quả do thiên tai gây ra; | b/ To work out plans on assurance of social security, order and safety when natural disasters occur, and coordinate with the Ministry of National Defense, ministries, ministerial-level agencies and localities in participating in the salvation and rescue of people affected by natural disasters and remediation of natural disaster consequences; |

| a) Ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành và chỉ đạo thực hiện văn bản quy phạm pháp luật về bảo đảm thông tin trong phòng, chống thiên tai; | a/ To promulgate according to its competence or submit to competent authorities for promulgation, and direct the implementation of, legal documents on assurance of information in natural disaster prevention and control; |
| b) Lập quy hoạch, kế hoạch và chỉ đạo thực hiện việc bảo đảm an toàn, thông suốt cho mạng thông tin chung; | b/ To elaborate master plans and plans on and direct the assurance of safety and uninterrupted operation of the general communication network; |

| a) Ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành và chỉ đạo thực hiện văn bản quy phạm pháp luật về bảo đảm giao thông trong phòng, chống thiên tai; | a/ To promulgate according to its competence or submit to competent authorities for promulgation, and direct the implementation of, legal documents on assurance of transport in natural disaster prevention and control; |
| b) Lập quy hoạch, kế hoạch và chỉ đạo thực hiện về phát triển giao thông vận tải phù hợp với chiến lược và kế hoạch phòng, chống thiên tai; | b/ To elaborate master plans and plans on and direct the transport development in line with the strategy and plans on natural disaster prevention and control; |
| c) Chuẩn bị lực lượng, phương tiên, vật tư cứu hộ giao thông, bảo đảm an toàn giao thông vận tải khi thiên tai xảy ra; | c/ To prepare manpower, means and supplies for traffic rescue and assurance of transport safety when natural disasters occur; |

| a) Ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành và chỉ đạo thực hiện văn bản quy phạm pháp luật về bảo đảm an toàn cho công trình hồ chứa thủy điện thuộc phạm vi quản lý trong phòng, chống thiên tai; | a/ To promulgate according to its competence or submit to competent authorities for promulgation, and direction the implementation of, legal documents on assurance of safety for hydropower reservoirs under its management in natural disaster prevention and control; |
| b) Lập kế hoạch về phòng, chống thiên tai; chỉ đạo thực hiện việc bảo đảm an toàn các khu vực khai thác khoáng sản, an toàn về nguồn điện và đường dây tải điện và các cơ sở công nghiệp do Bộ quản lý; | b/ To work out plans on natural disaster prevention and control; to direct the assurance of safety for mining zones, power sources and lines and industrial establishments under its management; |
| c) Chủ trì, phối hợp với Ủy ban nhân dân cấp tỉnh, có kế hoạch chuẩn bị các mặt hàng thiết yếu cung ứng cho nhân dân, chú trọng các vùng sâu, vùng xa, vùng thường xuyên bị thiên tai; phối hợp với chính quyền địa phương các cấp thực hiện tốt việc dự phòng tại chỗ; | c/ To assume the prime responsibility for, and coordinate with provincial-level People’s Committees in, working out plans on preparation and supply of essentials for local people, especially in deep-lying and remote areas and natural disaster-prone areas; and to coordinate with local administrations at all levels in making proper contingency preparations on the spot; |

| a) Ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành và chỉ đạo thực hiện văn bản quy phạm pháp luật về bảo đảm an toàn cho công trình xây dựng phù hợp với pháp luật về phòng, chống thiên tai; chủ trì, phối hợp và hướng dẫn địa phương thực hiện quy hoạch xây dựng, bảo đảm an toàn công trình trước thiên tai; | a/ To promulgate according to its competence or submit to competent authorities for promulgation, and direct the implementation of, legal documents on assurance of safety for construction works in accordance with the law on natural disaster prevention and control; to assume the prime responsibility for, and coordinate with and guide local administrations in, implementing construction master plans to assure safety of construction works during natural disasters; |

| b) Dự trữ thuốc, phương tiện y tế, hướng dẫn cho cán bộ y tế và cộng đồng về kỹ thuật cấp cứu thông thường, biện pháp vệ sinh môi trường; | b/ To reserve medicines and medical equipment and guide health workers and the community on common FirstAid techniques and environmental sanitation measures; |
| c) Chỉ đạo việc cấp cứu nạn nhân, phòng, chống bệnh dịch trước, trong và sau khi thiên tai xảy ra; | c/ To direct the provision of First Aid to injured people, and prevention and control of epidemics and diseases before, during and after natural disasters; |

| b) Xây dựng, phê duyệt và tổ chức thực hiện kế hoạch phòng, chống thiên tai thuộc phạm vi quản lý; | b/ To elaborate, approve and implement local plans on natural disaster prevention and control under their management; |
| c) Tổ chức thực hiện việc lồng ghép nội dung phòng, chống thiên tai vào quy hoạch, kế hoạch phát triển kinh tế - xã hội của địa phương; | c/ To integrate natural disaster prevention and control contents into local socio-economic development master plans and plans; |

| i) Chỉ đạo, tổ chức thực hiện biện pháp bảo vệ sản xuất khi xảy ra thiên tai để giảm nhẹ thiệt hại, nhanh chóng phục hồi sản xuất; | i/ To direct and organize the implementation of measures to protect production when natural disasters occur in order to reduce damage and quickly rehabilitate production; |

| b) Xây dựng, phê duyệt và tổ chức thực hiện kế hoạch phòng, chống thiên tai; lồng ghép nội dung phòng, chống thiên tai vào quy hoạch, kế hoạch phát triển kinh tế - xã hội của địa phương; | b/ To elaborate, approve and implement plans on natural disaster prevention and control; to integrate natural disaster prevention and control contents into local socio-economic development master plans and plans; |

| Điều 44. Cơ quan chỉ đạo, chỉ huy về phòng, chống thiên tai | Article 44. Agencies directing and commanding natural disaster prevention and control |
| 1. Ban chỉ đạo trung ương về phòng, chống thiên tai: | 1. The Central Steering Committee for Natural Disaster Prevention and Control: |
| a) Thủ tướng Chính phủ quyết định thành lập Ban chỉ đạo trung ương về phòng, chống thiên tai làm nhiệm vụ điều phối liên ngành, giúp Chính phủ, Thủ tướng Chính phủ tổ chức, chỉ đạo công tác phòng, chống thiên tai trên phạm vi toàn quốc; thành viên của Ban chỉ đạo bao gồm đại diện lãnh đạo của một số bộ, cơ quan có liên quan và làm việc theo chế độ kiêm nhiệm; | a/ The Prime Minister shall decide to set up the Central Steering Committee for Natural Disaster Prevention and Control to perform the task of interdisciplinary coordination and assist the Government and Prime Minister in organizing and directing natural disaster prevention and control nationwide; members of the Steering Committee include representatives of leaderships of related ministries and agencies, and work on a part-time basis; |
| b) Bộ Nông nghiệp và Phát triển nông thôn là cơ quan thường trực của Ban chỉ đạo trung ương về phòng, chống thiên tai và có cơ quan chuyên trách trực thuộc Bộ để tham mưu, giúp việc cho Ban chỉ đạo trung ương về phòng, chống thiên tai. | b/ The Ministry of Agriculture and Rural Development acts as the standing body of the Steering Committee, and has an attached specialized agency to advise and assist the Steering Committee. |
| 2. Bộ trưởng, Thủ trưởng cơ quan ngang bộ quyết định thành lập Ban chỉ huy phòng, chống thiên tai của bộ để giúp Bộ trưởng, Thủ trưởng cơ quan ngang bộ thực hiện công tác phòng, chống thiên tai trong phạm vi quản lý. | 2. Ministers and heads of ministerial-level agencies shall decide to set up commanding committees for natural disaster prevention and control of their ministries or agencies to assist them in performing natural disaster prevention and control work under their management. |

Chính phủ quy định cụ thể về cơ cấu tổ chức, nhiệm vụ của Ban chỉ đạo trung ương về phòng, chống thiên tai, Ban chỉ huy phòng, chống thiên tai của bộ, cơ quan ngang bộ, Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các cấp và cơ chế phối hợp giữa Ban chỉ đạo trung ương về phòng, chống thiên tai với Ủy ban quốc gia tìm kiếm cứu nạn. | 4. | Điều 45. Xử lý vi phạm pháp luật về phòng, chống thiên tai | Article 45. Handling of violations of the law on natural disaster prevention and control |
| 1. Cá nhân có hành vi vi phạm pháp luật về phòng, chống thiên tai thì tuỳ theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc bị truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật. | 1. Individuals who commit violations of the Law on Natural Disaster Prevention and Control shall, depending on the nature and severity of their violations, be disciplined, administratively sanctioned or examined for penal liability. If causing damage, they shall pay compensation in accordance with the law. |
| 2. Tổ chức vi phạm pháp luật về phòng, chống thiên tai thì tuỳ theo tính chất, mức độ vi phạm mà bị xử phạt hành chính, nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật. | 2.
